Terms of Use

These Terms govern access to and use of MortgageDirectory.ca, including directory listings, accounts, contact tools, calculators, forms, and related services. Please read them carefully. By creating, claiming, or activating an account or listing, submitting content, or otherwise using the Services, you agree to these Terms to the extent permitted by applicable law.

1. About MortgageDirectory.ca

MortgageDirectory.ca is a Canadian information and connection platform that allows consumers to discover and contact real estate professionals, mortgage professionals, brokerages, lenders, and related service providers. MortgageDirectory.ca is a directory and technology platform only unless expressly stated otherwise for a particular service.

MortgageDirectory.ca is not, merely by operating the directory, acting as a mortgage broker, mortgage agent, real estate brokerage, real estate salesperson, lender, appraiser, lawyer, accountant, insurer, financial adviser, or other regulated professional. Use of the Services does not create an agency, fiduciary, advisory, brokerage, employment, partnership, joint venture, or professional-client relationship with MortgageDirectory.ca.

2. Acceptance of These Terms

These Terms form a binding agreement between you and the owners and operators of MortgageDirectory.ca (“MortgageDirectory.ca”, “we”, “us”, or “our”) when you create an account, claim or activate a listing, submit information or content, use an account feature, or otherwise use the Services in a manner that legally signifies acceptance.

If we send a professional an invitation to review, claim, or activate a directory listing, activation or account creation confirms acceptance of these Terms and the Privacy Policy. The existence of an unclaimed listing alone does not mean that the listed professional has endorsed MortgageDirectory.ca or entered into a contract with us.

If you do not agree with these Terms, do not create or activate an account and discontinue use of account-based features.

3. No Verification, Endorsement or Guarantee

Directory information is provided for convenience. Unless we expressly state otherwise, MortgageDirectory.ca does not independently verify, certify, warrant, or guarantee:

  • Licensing, registration, accreditation, insurance, disciplinary history, legal standing, identity, employment, brokerage affiliation, or regulatory status of a listed person or business.
  • Experience, performance, availability, pricing, rates, specialties, service areas, representations, qualifications, reviews, rankings, claims, or results.
  • The accuracy, completeness, currency, legality, suitability, or reliability of any listing, image, profile, calculator result, third-party information, or user-supplied content.
  • That a consumer will receive any particular service, approval, mortgage rate, loan, property, result, savings, referral, response, or transaction outcome.

Consumers are solely responsible for performing their own due diligence before engaging any professional or provider, including checking applicable provincial or territorial regulator records, licences, credentials, insurance, references, conflicts, fees, terms, and service suitability.

4. No Professional, Financial or Legal Advice

Content on the Services is general information and may not reflect your circumstances. Directory listings, calculators, estimates, articles, ratings, search results, or other site content are not professional, legal, financial, mortgage, investment, tax, or real-estate advice and should not be relied upon as a substitute for advice from a qualified professional. Calculator and rate information may be illustrative, estimated, delayed, incomplete, or subject to assumptions and eligibility conditions.

5. Your Dealings With Professionals and Other Third Parties

Any communication, quotation, application, representation, service, referral, contract, fee, transaction, dispute, or relationship between a consumer and a listed professional, lender, brokerage, business, or Partner is solely between those parties. MortgageDirectory.ca is not a party to those dealings unless expressly identified in a separate written agreement.

You are responsible for deciding whether to contact, hire, retain, rely on, pay, refer to, or transact with another user or third party. We do not warrant the conduct, competence, solvency, honesty, licensing, privacy practices, services, or results of any third party.

6. Accounts and Listings

  • You must provide information that is accurate to the best of your knowledge and promptly correct material inaccuracies in an account or claimed listing.
  • You are responsible for safeguarding account credentials and all activity performed through your account.
  • You may not claim, alter, impersonate, or control a listing for another person or business without authorization.
  • We may create or display unclaimed listings using professional or business information obtained from lawful public sources. We may invite a listed professional to claim or activate the listing.
  • We may refuse, suspend, restrict, unpublish, merge, correct, or remove accounts or listings where reasonably necessary to protect the Services, comply with law, respond to credible complaints, address duplication or inaccuracies, or enforce these Terms.

7. User Content and Licence to MortgageDirectory.ca

“User Content” includes text, photographs, images, logos, videos, trademarks, profile information, reviews, documents, data, descriptions, and other materials that you upload, submit, provide, publish, or authorize us to use.

You retain any ownership rights you lawfully hold in your User Content. By submitting or publishing User Content through the Services, you grant MortgageDirectory.ca and its owners, operators, affiliates, successors, service providers, and partner sites a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence, for the duration of the applicable intellectual-property rights, to host, store, reproduce, format, adapt for technical or promotional presentation, publish, display, distribute, communicate, index, cache, link to, and use that User Content for operating, promoting, improving, syndicating, and supporting MortgageDirectory.ca and related or partner directory services.

This licence does not give us ownership of your underlying intellectual property. To the extent permitted by law, you authorize us to make reasonable formatting, sizing, cropping, metadata, and technical changes needed to display content across devices, directories, social or promotional channels, and partner sites. You may request removal of account-controlled content, subject to legal retention needs, existing third-party copies, prior authorized distributions, and other rights that survive termination by their nature.

8. Your Content Responsibilities

You represent and warrant that you have all rights, permissions, licences, releases, and authority necessary to submit User Content and grant the licence above, and that your User Content and use of the Services do not knowingly infringe or violate the rights of another person.

  • Do not upload images, logos, photographs, copyrighted materials, personal information, or other content that you are not authorized to use.
  • Do not submit false, misleading, defamatory, fraudulent, discriminatory, unlawful, deceptive, impersonating, malicious, or materially inaccurate content.
  • Do not post confidential information or sensitive personal information unless it is necessary for an expressly provided feature and you are authorized to do so.
  • Do not use the Services to misrepresent licensing, qualifications, approvals, rates, specialties, business relationships, or professional status.

9. Copyright, Image and Content Complaints

MortgageDirectory.ca may contain content supplied by users, businesses, public sources, partners, or other third parties. We do not represent that every third-party item is owned by MortgageDirectory.ca, and we cannot guarantee that every submission was authorized by the underlying rights holder.

If you believe content infringes your copyright, trademark, privacy, publicity, or other legal rights, email admin@mortgagedirectory.ca and include: (a) the URL or precise location of the content; (b) a description of the material; (c) your name and contact information; (d) the right you claim; (e) enough information to evaluate the complaint; and (f) any proof of authority if you act for the rights holder. We aim to review credible notices within 24–48 business hours and may remove, disable, replace, restrict, or request further information as appropriate. This is a review target, not a guarantee of final resolution within that timeframe.

We may restore or retain content where a complaint is incomplete, disputed, legally unsupported, or where applicable law permits or requires continued availability. Nothing in these Terms limits rights or procedures available under applicable intellectual-property law.

10. Publicly Available Information and Professional Contact Data

We may collect and display professional or business information from sources that are publicly accessible where permitted by law and where the use is reasonably connected to the purpose for which the information was made available or to communicating with the professional in a business capacity. The fact that information appears online does not, by itself, mean that every collection, reuse, message, or republication is lawful.

If you believe a directory listing contains inaccurate, outdated, inappropriate, or unlawfully used information, contact us or use available account/profile tools to request correction or removal.

11. Electronic Communications and CASL

MortgageDirectory.ca may send account, security, support, activation, listing-management, inquiry, or other service-related messages. Commercial electronic messages are sent only where we believe there is a lawful basis under Canada’s Anti-Spam Legislation (“CASL”) or other applicable law, including express consent, valid implied consent, or another applicable exception.

Where an initial outreach message is sent to a business email address obtained from a public source, MortgageDirectory.ca does not treat mere online availability as blanket consent. If relying on conspicuous publication, the legal conditions for that basis must be met, including relevance to the recipient’s business role and the absence of a statement that unsolicited commercial electronic messages are not wanted. Applicable identification and unsubscribe requirements will be included. Requests to unsubscribe from commercial messages will be processed within the legally required period.

Activation, account creation, or a later affirmative opt-in may provide additional permissions for communications, but only to the extent permitted by law. Users may withdraw marketing consent as provided in the applicable message or account settings, subject to messages that remain necessary for security, requested services, legal compliance, or account administration.

12. Privacy

Our handling of personal information is described in the MortgageDirectory.ca Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that information may be processed and disclosed as described there, subject to applicable law and any consent requirements.

When you use a contact form, calculator, lead form, comparison tool, or other feature to request contact or services, you authorize us to transmit the information you provide to the professional, business, lender, brokerage, or service Partner reasonably associated with your request. You should not submit information you do not want provided to the intended recipient.

13. Acceptable Use

You may use the Services only for lawful purposes. Without our prior written permission, you must not:

  • Scrape, harvest, crawl, extract, copy, sell, license, republish, or compile directory data at scale through automated means, except where expressly permitted by law or by a written licence from us.
  • Use bots, scripts, automated requests, or technical methods that interfere with, overload, bypass, probe, reverse engineer, or disrupt the Services or their security measures.
  • Use directory information to send unlawful spam, phishing, fraudulent solicitations, harassment, or communications that violate CASL or other applicable laws.
  • Circumvent access controls, impersonate another person, attempt unauthorized access, introduce malware, or use the Services for unlawful surveillance or data exploitation.
  • Copy or use MortgageDirectory.ca branding, database structure, original site content, or other proprietary material except as permitted by these Terms or law.

14. Site Content and Intellectual Property

Except for User Content and third-party materials, the Services—including original site text, design, layout, databases, software, branding, compilation, selection and arrangement of content, and other materials—are owned by or licensed to MortgageDirectory.ca and are protected by applicable intellectual-property laws. No right or licence is granted except the limited right to access and use the Services in accordance with these Terms.

15. Third-Party Links, Tools and Services

The Services may contain links, embedded tools, advertisements, integrations, listings, rates, forms, calculators, or content supplied by independent third parties. We do not control and are not responsible for their terms, privacy practices, security, availability, products, services, statements, or conduct. A link, ranking, listing, referral, or inclusion does not constitute endorsement unless expressly stated.

16. Service Availability and Changes

We may modify, update, suspend, discontinue, restrict, or change any part of the Services, listings, features, eligibility criteria, ranking methods, categories, or content at any time, subject to applicable law. We do not guarantee continuous, uninterrupted, secure, or error-free availability, or that data will never be lost, delayed, altered, or unavailable.

17. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL DIRECTORY INFORMATION, CONTENT, CALCULATORS, LISTINGS, LEADS, LINKS, DATA, AND FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT REPRESENTATIONS, WARRANTIES, CONDITIONS, OR GUARANTEES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR COLLATERAL. THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, QUALITY, AVAILABILITY, SECURITY, AND RESULTS.

Some jurisdictions do not permit certain exclusions. In those jurisdictions, the exclusions apply only to the maximum extent legally permitted. Nothing in these Terms excludes a statutory warranty, condition, right, or remedy that cannot lawfully be excluded or waived.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MORTGAGEDIRECTORY.CA AND ITS OWNERS, OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, DATA, GOODWILL, OR SAVINGS; OR LOSSES ARISING FROM OR RELATING TO A PROFESSIONAL OR THIRD PARTY, A DIRECTORY LISTING, A TRANSACTION, RELIANCE ON CONTENT, UNAUTHORIZED USER CONTENT, SERVICE INTERRUPTION, SECURITY INCIDENT, OR USE OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSS.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF MORTGAGEDIRECTORY.CA FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO MORTGAGEDIRECTORY.CA FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT; AND (B) CAD $100. THIS LIMIT DOES NOT APPLY WHERE APPLICABLE LAW PROHIBITS SUCH A LIMITATION.

The parties agree that these limitations allocate risk between them and are an essential basis of the Services being offered, including where access is provided without charge. No provision is intended to prevent a person from bringing a claim or exercising a remedy that cannot lawfully be waived or limited.

19. Indemnity

To the extent permitted by law, if you use the Services as a business, professional, brokerage, lender, service provider, or account holder, you agree to indemnify and hold harmless MortgageDirectory.ca and its owners, operators, affiliates, officers, directors, employees, contractors, and agents from third-party claims, losses, liabilities, damages, penalties, costs, and reasonable legal fees arising from your User Content, your services or dealings with another person, your breach of these Terms, your violation of law, your infringement of another person’s rights, or your misuse of the Services. This obligation does not apply to the extent a claim is caused by the indemnified party’s own conduct where indemnification is prohibited by law.

20. Suspension and Termination

You may stop using the Services at any time and may use available profile tools to delete or deactivate an account, subject to retention described in the Privacy Policy. We may suspend, restrict, or terminate access or remove content where reasonably necessary to enforce these Terms, protect users or the Services, address legal or security concerns, respond to complaints, or discontinue the Services.

Provisions that by their nature should survive termination—including intellectual-property licences for prior uses, disclaimers, liability limits, indemnity obligations, governing law, dispute provisions, and accrued rights—will survive to the extent permitted by law.

21. Governing Law and Disputes

These Terms and any dispute relating to the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles, except where mandatory consumer-protection or other law requires otherwise. Subject to any non-waivable right to bring a proceeding elsewhere, the parties submit to the courts located in Ontario for disputes arising from these Terms or the Services.

Before commencing formal proceedings, users are encouraged to contact admin@mortgagedirectory.ca with a concise description of the concern so the parties can attempt to resolve it informally. This does not suspend a legal limitation period or waive any right unless expressly agreed in writing.

22. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date identifies the current version. Changes apply prospectively when posted or on any later effective date stated in the updated Terms. Where required by law, we will provide additional notice or obtain consent. Continued use after changes take effect constitutes acceptance only to the extent legally valid.

23. General Provisions

  • Severability. If a provision is found invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect.
  • No waiver. Failure to enforce a provision is not a waiver of that provision or any other right.
  • Assignment. You may not assign your account or rights under these Terms without our consent. We may assign these Terms in connection with a business transfer, reorganization, or successor to the Services, subject to applicable law.
  • Entire agreement. These Terms, the Privacy Policy, and any additional written terms expressly applicable to a feature constitute the agreement governing use of the Services, except for a separate written agreement signed by the applicable parties.
  • Headings. Headings are for convenience only and do not affect interpretation.

Nothing in these Terms is intended to exclude, restrict, or waive liability, rights, remedies, obligations, or protections that cannot lawfully be excluded, restricted, or waived under applicable law.
